These Terms and Conditions ("Terms") form a legally binding agreement between you and Rory Boon, doing business as TwoTread ("we", "us", or "our"), based in South Africa.
We operate the mobile application TwoTread (the "App"), a free service for motorcyclists in South Africa that helps riders find safe parking spots through a community-curated map. Users can browse spots without an account, or create a free email-based account to submit spots, upload photos, and vote on whether spots are safe or unsafe.

The Services are intended for users aged 13 and older. If you are a minor (typically under 18, depending on your jurisdiction), you must have the permission of, and be supervised by, your parent or guardian to use the Services.
The Services are intended for use by riders located in South Africa. They are not intended for distribution to or use by any person in any jurisdiction where such use would be contrary to law or regulation. If you choose to access the Services from outside South Africa, you do so on your own initiative and are responsible for complying with local laws.
We own or licence all rights to the source code, databases, software, designs, text, graphics, and trademarks that make up the Services (the "Content" and "Marks"). The Content and Marks are provided to you "as is" for your personal, non-commercial use only.
You may access the Services and download or print portions of the Content for personal use only. You may not copy, reproduce, redistribute, sell, or commercially exploit any part of the Services without our written permission.
If you send us feedback, suggestions, or other ideas about the Services ("Submissions"), you assign all rights in those Submissions to us. We can use them freely without compensating you.
When you post parking spot descriptions, photos, votes, or other content ("Contributions"), you keep ownership of that content but grant us a worldwide, royalty-free, perpetual licence to use, display, distribute, and modify it as part of the Services. You are responsible for ensuring you have the right to share what you upload.
By using the Services, you represent and warrant that:
You may need to register an account to submit spots or vote. You are responsible for keeping your password confidential and for all activity on your account. We may reject or change a username if we consider it inappropriate.
You may not use the Services for any purpose other than the one for which we provide them. You agree not to:
The Services allow you to create, post, and share Contributions. By making a Contribution, you represent and warrant that:
Contributions may be visible to other users of the Services. We are not responsible for the content of Contributions.
We operate a zero-tolerance policy for objectionable content and abusive behaviour. Within the App you can report any spot you believe is inappropriate, and you can block any contributor — once blocked, that rider's spots are removed from your map immediately. We review reported and blocked content and aim to act within 24 hours, removing the content and, where necessary, removing the user responsible. To report content or a user outside the App, email support@twotread.com.
By posting Contributions, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, copy, reproduce, distribute, publish, display, and modify them in connection with the Services. You retain ownership of your Contributions, but you waive moral rights to the extent permitted by law.
We may edit, remove, or refuse to publish any Contribution at our sole discretion, without notice.
We grant you a revocable, non-exclusive, non-transferable, limited licence to install and use the App on devices you own or control, strictly in accordance with these Terms. You may not:

If we offer the option to link your account to a third-party service (such as Apple ID or Google), you authorise us to access and store certain profile information from that service. The third-party service's terms and privacy policy govern your relationship with them. You may disconnect a linked account at any time through your account settings.

These Terms remain in effect while you use the Services. We may, at our sole discretion and without notice, suspend or terminate your access to the Services for any reason, including for breach of these Terms or applicable law. We may also delete your account and any associated content at any time, without warning.
If we terminate your account, you may not register a new account under your own name, a fake name, or someone else's name.
We may change, modify, or remove the Services at any time without notice. We are not liable to you for any modification, suspension, or discontinuation of the Services.
The Services may experience downtime, maintenance, or technical problems. We do not guarantee the Services will always be available and are not liable for any loss or inconvenience caused by interruptions.
We will provide reasonable advance notice (at least 7 days where practical) of material changes to these Terms by email to legal@twotread.com recipients or through an in-app notice. Updates required for security reasons or to comply with a court order may take effect immediately.
These Terms are governed by the laws of South Africa. You and we agree that the courts of South Africa have exclusive jurisdiction over any dispute arising from these Terms.
You agree to submit any disputes related to these Terms to the courts of South Africa. We retain the right to bring proceedings in the courts of the country where you reside.
The Services may contain errors, inaccuracies, or omissions. We reserve the right to correct any of these and to update information at any time without prior notice.
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranties about the accuracy or completeness of parking spot information, the safety of any location, or the suitability of any spot for your motorcycle. You are solely responsible for assessing the safety and legality of any parking location before using it. We are not liable for any theft, damage, fines, or other loss you may suffer.
IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WILL BE LIMITED TO THE AMOUNT YOU HAVE PAID US, IF ANY. AS THE SERVICES ARE FREE, THIS AMOUNT IS ZERO.
Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.
You agree to defend and indemnify us from any loss, damage, liability, or claim made by a third party arising from:
We perform routine backups of data, but you are responsible for any data you transmit or activity you undertake using the Services. We are not liable for any loss or corruption of your data.
By using the Services, you consent to receive communications from us electronically (by email or in-app notification). You agree that all electronic agreements, notices, and disclosures satisfy any legal requirement for written communication.
These Terms (together with our Privacy Policy) constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. We may assign our rights and obligations to others. There is no joint venture, partnership, or employment relationship created by these Terms.
